The Welsh Government has published the Flood and Water Management Act 2010 (Commencement No. 8 and Transitional Provisions) Order 2012 (SI 2012/2048).
This order brings into force section 42 of the Flood and Water Management Act 2010 on 1 October 2012, in relation to sewerage undertakers whose areas are wholly or mainly in Wales.
Section 42 inserts a new section 106B into the Water Industry Act 1991 so as to provide that:
A developer cannot connect new private sewers and lateral drains (SLDs) to the public sewerage system unless it has entered into an adoption agreement with the sewerage undertaker.
The adoption agreement must require the developer to build the SLD to standards set by the Welsh Ministers unless the developer and sewerage undertaker expressly agree to depart from those standards.
The sewerage undertaker must adopt the SLD.
There are transitional arrangements for building developments that are in progress or are due to start soon.
